No tax is payable under the settlement, and the Rauschenberg has been donated to the Museum of Modern Art . The case has left no guidelines as to whether the IRS would in another case be entitled to set a value on a legally unsaleable artwork, but in this instance common sense seems to have prevailed.

In case you missed it, the IRS was trying to tax and penalize the inheritors of this piece over $40 million dollars even though, due to the stuffed bald eagle, it is unsellable.
